Terms & Conditions
These general conditions govern the sales relationship between Tantra Group srl, Via Aniello Falcone 394 Naples 80127, VAT number 07755291213, REA:NA-907170 and the buyer, who may be a consumer or a professional, hereinafter referred to as the customer and/or user.
By user and/or customer, we mean the natural and/or legal person, located within the EU
A consumer is defined as a natural person who acts for purposes other than any entrepreneurial, commercial, artisanal or professional activity carried out (see art. 3 paragraph 1 letter a) of the Consumer Code.
A professional is defined as a natural or legal person who acts in the exercise of his/her entrepreneurial, commercial, artisanal or professional activity, or his/her intermediary (see art. 3, paragraph 1, letter c) of the Consumer Code.
1 Methods of concluding the contract
- 1.1. To proceed with the purchase, the customer, after having completed the registration procedures and/or having accepted by ticking the appropriate box Terms and Conditions, constitutes for all legal purposes a binding offer for the purchase of the goods and of this contract.
- 1.2 Orders can only be placed by adults who are not under legal incapacity.
- 1.3 By purchasing a product from the Tantra group, the customer accepts all the conditions indicated.
- 1.4 The Order is not binding for the Tantra Group company which, without prejudice to what is specified, may at its discretion not process the order without any obligation towards the customer.
- 1.5 Without prejudice to the provisions of this contract, Tantra Group reserves the right to change these conditions without notifying the customer.
- Payments
- Tantra Group company accepts the following payment methods:
- 2.1 Bank Transfer
- 2.2 PayPal: For payments via PayPal (www.paypal.com), please refer to the terms and conditions of use of PayPal services. The data entered on the PayPal site will be processed directly by PayPal and will not be transmitted or shared with the Site.
- 2.3 Klarna: Payment in 3 interest-free installments, using a credit card, provided that the customer meets Klarna's requirements ( https://www.klarna.com )
- 2.4 Credit Card: Payment with Visa, Mastercard, American Express, through the Nexi circuit.
- 2.5 Tantra Group will issue the refund within 30 days through the same payment circuit chosen by the customer
3 Billing
- 3.1 Tantra Group will issue an invoice to the customer only if:
The customer has made an express request during the purchase phase and not subsequently, and has provided all the data (name, surname, residential address, city, postcode and tax code) for the relevant issue.
- 3.2 If the customer does not request the invoice at the time of purchase and/or has not provided all the data for the relative issuance, Tantra Group will not issue an invoice, as foreseen. from Art. 22, DPR 633/72
- 3.3 Tantra Group will send the invoice electronically within 10 days to the tax drawer
- Prices
- 4.1 The published prices are expressed in "Euro" currency and include VAT (regime of the country in which the goods are sold) and shipping costs.
- 4.2 Prices may vary in relation to promotions, commercial strategies or increases due to inflation and the increased price of raw materials and suppliers.
- 4.3 The amount that the buyer will have to pay will be the one displayed at the time of confirmation of the purchase.
- Terms and Conditions of Delivery
- 5.1 Tantra group will ship the order within 5-7 working days from the date of order confirmation.
- 5.2 Delivery times are generally 10-15 working days, to be calculated from the date of handing over to the courier.
- 5.3 Delivery times depend on the courier operating and are entirely indicative, therefore Tantra Group will not be responsible for any delays.
- 5.4 Delivery times may vary significantly depending on the reference area, islands and/or areas not served every day by the courier, possible strikes and/or protests, and/or other unforeseen events not caused by the courier.
- 5.5 The courier usually does not deliver on Saturdays, Sundays and public holidays (red calendar days).
- 5.6 The courier will deliver the goods to the name, address, street number and city indicated by the customer during the purchase phase.
- 5.7 The customer is required to view the progress of the shipment through the courier website, using the shipment number provided by Tantra Group, in order to facilitate the receipt of the order.
- 5.8 Delivery is only expected at street level and any telephone notices are at the discretion of the courier.
- 5.9 In the event that the courier cannot find the customer at the time of delivery and/or is unable to contact the customer, the goods will be placed in storage in the courier's warehouses.
- 5.10 Any changes made by the customer and/or agreements between the customer and the courier exclude Tantra Group from any liability and problems arising from them.
- 5.11 The customer must check and accept only intact packages upon delivery, always signing with reservation of inspection.
- 5.12 If the purchased product is damaged upon delivery, the customer must refuse the goods.
- 5.13 If this procedure has not been carried out, the customer will be solely and exclusively responsible for any discrepancies and/or breakages with full forfeiture of any rights on the part of the customer.
- 5.14 All goods are shipped bagged, rolled and/or folded under vacuum using special machinery, placed in a cardboard box in order to preserve its integrity.
- Order and Products
- 6.1 All goods are shipped bagged, rolled and/or folded under vacuum using special machinery, placed in a cardboard box in order to preserve its integrity.
- 6.2 All products and/or sizes sold by Tantra Group, chosen by the customer during the purchase phase, will be goods made to measure or clearly made specifically based on the customer's choice and will therefore be personalised goods.
- 6.3 Tantra Group, given the global situation of shortage of raw materials, reserves the right to modify the product even after purchase, without giving prior notice to the customer.
- 6.4 Any changes may concern the shape of the slabs, the number of layers, the colours, the fabric.
- 6.5 Any variations, however, will not affect the consistency, the height of the finished product, and the use of the product for which it is intended.
- Warranty
- 7.1 The products sold are covered by the manufacturer's warranty for defects of conformity, lasting 12 months if the customer is a "professional" and lasting 24 months if the customer is a "consumer", this term starts from the date of delivery of the goods.
- 7.2 All products must be opened from the original packaging (vacuum-packed) within and no later than 20 days from the date of receipt of the product, after which time the products will no longer be covered by the guarantee for any defects found at the time of opening.
- 7.3 Any discrepancies must be clearly communicated with a description and photos within and no later than 3 days from opening the product, otherwise there will be full forfeiture of any right by the customer
- 7.4 The guarantee does not apply in cases of depressions in the surfaces used of less than 20 mm, as these values are considered physiological.
- 7.5 A tolerance of ± 10% on measurements, due to the assembly of elastic components, is to be considered normal and does not constitute a defect.
- 7.6 The guarantee also does not cover:
the formation of pilling, fraying, fabric tears, cuts, incisions, damage caused by impacts, transport damage, consequent or causal, normal wear and tear, organic stains, incorrect maintenance, failure to follow the instructions for use and maintenance, negligence and carelessness in the use and environment for which the product is intended and circumstances which in any case cannot be attributed to manufacturing defects and/or conformity, which do not affect the use of the product for which it is intended
- 7.7 The customer is not authorised in any way to manipulate, modify or carry out other manoeuvres on the product, without the express consent of Tantra Group, with the immediate forfeiture of the guarantee and of any right on the part of the customer.
- 7.8 To make an exception to the guarantee, the product must be complete in all its parts including the original packaging.
- 7.9 The customer is required to send the order data, a detailed description, photos of any discrepancies within and no later than 5 days of discovery by email to: assistenza.tantragroup@gmail.com, otherwise the guarantee will be completely forfeited.
- 7.10 Once the documentation has been analyzed, Tantra Group will have the right to request any additional documentation, the client must send what is requested within and no later than 3 days. Once the documentation has been verified complete, Tantra Group will give a response to the client within 10 working days.
- 7.11 The customer will send the product for repair at his own expense.
- 7.12 Once Tantra Group has received the product, it will verify within 30 working days whether any discrepancies are covered by the guarantee.
- 7.13 If the problem falls within the warranty, Tantra Group will proceed to repair the parts. If it is not possible to repair the parts of the product, Tantra Group will replace them with an equivalent and/or superior product.
- 7.14 If the product does not fall within the cases covered by the warranty, the customer will have 10 working days from the communication from Tantra Group to collect the product. If the product is not collected within the aforementioned period, Tantra Group will proceed with its disposal, and any costs will be charged to the customer.
- Maintenance tips and use
Tantra Group recommends:
- Wait at least 12/48 hours after opening the product, let it rest for optimal recovery and before first use.
- It is recommended to wait at least 15/20 days of use to get used to the product
- Use mattress covers
- Rotate the product (head-to-foot, upside-down) at least once a week, air the product periodically, keeping it in the open air for a few hours, without exposing it to the sun.
- Avoid jumping on the product as it may damage it irreparably.
- Avoid sitting and/or sleeping on the final part of the 4 sides of the product
- Do not use solvents or chemicals if the product should get stained
- Do not wet the product with liquids of any kind, as this would compromise its consistency and healthiness.
- For organic stains, it is recommended to change the product.
- Avoid using the iron, hair dryer or any other heat source on the fabric and/or internal structure
- Any sterilizations aimed at “sanitizing” the problem do not solve the problem of mites but rather compromise the consistency and duration of the product.
- Any use of electric blankets may affect the consistency and durability of the product.
- It is recommended to gently brush or use low-power vacuum cleaners to remove dust.
- Use the product on an adequate base, an inadequate base may seriously affect the product structure and its performance, therefore:
- For mattresses, the base must be elastic but not excessively yielding, a slatted base must be used, the base must be of equal or greater dimensions than the dimensions of the product.
- The product must have supports without side members raised above the slat level.
- The product must be used on a ventilated base, which must guarantee correct ventilation.
- The width of the slats must not exceed 5 cm, the slats must be arranged in a uniform pattern across the entire size of the base.
- If using old bases and/or bases with boards, it is necessary to check their suitability with the dealer.
- Do not fold, roll or tie the product tightly, as these actions may irreparably damage the product.
- For the disposal of the product, we recommend asking your municipality of residence
- Withdrawal
- 9.1 The customer loses the possibility of exercising the right of withdrawal, as provided for by Legislative Decree 206/2005, art. 59: The supply of sealed goods that are not suitable to be returned for reasons of hygiene or related to health protection and have been opened after delivery. The supply of goods packaged to measure or clearly personalized. For lack of the essential condition of integrity of the product, lack of original packaging and everything sent to the customer. As also provided for by the directive DIRECTIVE 2011/83/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 25 October 2011, ART.16
- 9.2 The customer may not return the goods in part with respect to the purchased goods.
- 9.3 Tantra Group will give the customer the possibility to return the purchased goods, provided that the customer has sent a request within 14 days from the date on which he received the goods, to the email address assistance.tantragroup@gmail.com (If the customer has purchased a good through a portal not owned by the Tantra group, the customer must necessarily send the request also through the portal from which he purchased). In the request the customer must: clearly specify the reason for the return, name and surname, order number and photo of the product, all of which must be sent within and no later than 3 days from the request, to assistance.tantragroup@gmail.com ,otherwise the practice will be closed automatically.
- 9.4 Tantra Group, having analysed the documentation, will in any case have the right to decide whether there are the conditions to accept the client's request and will communicate this to the client within 7 days.
- 9.5 In case of acceptance of return, the customer must return the goods to Tantra Group within 14 days
- 9.6 The customer must return the purchased item intact and accompanied by the original packaging, complete in all its parts, taking care not to tear the labels and not to dirty the goods, i.e. it must be in the same condition as when received, the package must not be folded/rolled and/or tied tightly, placed in an envelope and then in a cardboard box.
- 9.7 The costs of packaging, return of the goods and choice of courier will be the responsibility and expense of the customer, who must send the goods to Tantra Group, without undue delay, no later than 14 days from the date of the withdrawal request.
- 9.8 If the customer chooses to use the Tantra Group courier, he/she must follow the return instructions provided. It is specified that Tantra Group may refuse to make its own courier available.
- 9.9 The courier costs for each individual package are:
On Italian territory
Euro 189.00 for mattresses with dimensions from 140×190 to 180×200
Euro 149.00 for mattresses with dimensions from 80×190 to 120×200
Euro 109.00 for all topper sizes
Euro 59.00 for pillows
On European territory:
Euro 239.00 for mattresses with dimensions from 140×190 to 180×200
Euro 189.00 for mattresses with dimensions from 80×190 to 120×200
Euro 139.00 for all topper sizes
Euro 69.00 for pillows
- 9.10 These amounts will be deducted from the refund payment, and applied even if the customer has second thoughts and refuses the goods during delivery.
10 Applicable law – Competent court
- 10.1 These General Contract Conditions are governed exclusively by Italian Law.
- 10.2. Any dispute – without exception and/or exclusion – relating to the interpretation or execution, even partial, of these conditions, will be under the exclusive jurisdiction of the Court of Naples.
- 10.3. In the event that the Customer is a consumer (i.e. a natural person acting for purposes other than entrepreneurial, commercial, artisanal or professional activity, possibly carried out – see art. 3 Legislative Decree 206/2005 -) (and subsequent amendments) the court of Naples will have jurisdiction.
- 10.4. By purchasing a product from the Tantra group, the customer accepts all the conditions indicated.
